The 1964 Homes Association Handbook is the HOA “bible.” Here’s an example of the objectives of the origins of HOA-Land:

The last paragraph of the Foreword by the then ULI (Urban Land Institute) President reads:

“It is our firm belief that the information and recommendations contained in the handbook will be of major value to land developers, planners, home builders, appraisers, mortgage lenders, realtors, attorneys, association officers, and public officials concerned with the planning, development, and operation of stable and attractive residential areas for the home owner and the community.”

Reads like a money-making venture with a social value attached. Like selling a business product for the backers. The Handbook has no references to questions of local government or constitutional validity. But over the course of years HOAs have been sold as protecting property values, the greatest form of democracy, and “care-free living” among other “community” connotations. All purchased under a real estate contract and not under a commercial business or stock contract. Is this misrepresentation?

The overall intent and purpose of this webinar series is the education and reorientation of HOA members, especially the board of directors, to long ignored issues of constitutional validity; issues that the public will not find in the multitude of materials and publications of that business trade group, Community Associations Institute, CAI.

The reorientation project is the first step toward the understanding and acceptance of my Plan Toward the Restructuring the HOA Model of Governance; it requires an examination of the role and influence of CAI in supporting and promoting the HOA legal concept and model of government.

BOD education webinar on HOA realities in final stages

A FREE StarMan Group webinar series to educate and reorient HOA boards and the public in general is in its final stages of development. This HOA educational series is based on the collection, “Restoring the Lost Constitution to HOA-Land.” See “HOA board education in constitutionality.”

The first session makes the case why HOA boards need to be educated as they are functioning in the blind with respect to constitutionality issues and the denial of member rights and freedoms. The final session will address The Plan to Restructure the Model of HOA Governance.

HOA advocate to advise committee on UCIOA revision

I was invited to participate in the drafting of revisions to the Uniform Law Commission’s (ULC) Uniform Common Interest Ownership Act (UCIOA) and Uniform Condominium Act (UCA). As an invited Observer with full participation rights I bring “in the trenches” in-depth experience and extensive research to restore the lost Constitution to HOA-Land.

With the advocates’ failure to nationally unite and collaborate to attain substantive HOA reforms, going forward with ULC’s statewide collaborative approach will benefit all interested parties, including HOA members. The drafting committee is comprised of conscientious and dedicated unpaid volunteer attorneys appointed by their state. Uniform Acts (UCC for example) adopted by ULC are presented to state legislators to adopt and to ease the disorder brought about by different rules in different states that affect a person’s home in an HOA.

My late 12 hour introduction into the amend and revise procedure allowed me to orient myself to the functioning of the UCIOA committee as well as presenting a few points of view. The proposed UCIOA changes are in the review process and need to be approved by the ULC commissioners at their annual meeting, yet to be determined as a result of the coronavirus restrictions.

When and if future revisions to UCIOA are in order I hope to participate more fully.
