  1. Hi! I recently had a Hospital stay, and as such was researching Medical Lien Laws in Florida. I came across this which states the Florida Supreme Court has ruled the State Law allowing Medical Liens unconstitutional! “It was held that the use of
    special acts to authorize medical liens was unconstitutional. The statewide lien law was deemed unconstitutional as it was a “Special Law” in violation of
    Article III, section 11(a)(9) of the Florida Constitution which states, in part: (a) There shall be no special law or general law of local application pertaining
    to:… (9) creation, enforcement, extension or impairment of liens based on private contracts, or fixing of interest rates on private contracts.” They also ruled though the individual counties can enact their own ordinance which some have many others have not.
    My question is since HOA’s are private entities, wouldn’t this also apply to them, since the laws governing them are based on the Covenants the members agree to and is considered a private contract?

    1. Your question reveals the lack of protection by the state in enforcing constitutional protections of your rights. HOA reform legislation is an attempt to those rights taken aware from unsuspecting homebuyers.
